Donald Green<\/span><\/i><span data-contrast=\"auto\">, No. 92CR159:<\/span><span data-ccp-props=\"{&quot;134233279&quot;:true,&quot;201341983&quot;:0,&quot;335559739&quot;:0,&quot;335559740&quot;:240}\">\u00a0<\/span><\/p>\n<p style=\"padding-left: 40px;\"><span data-contrast=\"auto\">Within one month of being sworn in, Judge Heckman was assigned this multidefendant case involving charges including racketeering, racketeering conspiracy, and narcotics conspiracy.\u00a0 Defendants were alleged to be members of the \u201cLA Boys,\u201d a major narcotics trafficking enterprise that operated in Buffalo, New York.\u00a0 The lead defendant, Donald \u201cSly\u201d Green, was alleged to have orchestrated the enterprise\u2019s criminal activities using prison telephones at Shawangunk Correctional Facility, where he was serving a sentence for murder.\u00a0 The pivotal suppression issue in the case was whether approximately 1,000 telephone conversations involving Green should be suppressed because the recordings were made in violation of Title III of the Omnibus Crime Control &amp; Safe Streets Act, 18 U.S.C. \u00a7\u00a7\u202f2510 <\/span><i><span data-contrast=\"auto\">et seq.<\/span><\/i><span data-contrast=\"auto\">, the Fourth Amendment, and the New York State Constitution.\u00a0 Judge Heckman recommended denial of the motion to suppress on the basis that the defendant impliedly consented to the recordings.\u00a0 Judge Curtin, the district judge assigned to the case, adopted Judge Heckman\u2019s recommendation and denied the motion. Schlegel<\/span><\/i><span data-contrast=\"auto\">, No. 91CV633:<\/span><span data-ccp-props=\"{&quot;134233279&quot;:true,&quot;201341983&quot;:0,&quot;335559739&quot;:0,&quot;335559740&quot;:240}\">\u00a0<\/span><\/p>\n<p style=\"padding-left: 40px;\"><span data-contrast=\"auto\">The <\/span><i><span data-contrast=\"auto\">pro se <\/span><\/i><span data-contrast=\"auto\">plaintiff in this matter alleged that he was denied tenure in retaliation for exercising his First Amendment rights.\u00a0 Judge Heckman recommended denial of plaintiff\u2019s motion for a preliminary injunction, a recommendation that was adopted by the District Court and affirmed by the Second Circuit.\u00a0 As the case proceeded, Judge Heckman resolved several motions and discovery disputes and presided over several hearings that became increasingly contentious.\u00a0 A dispute arose concerning the discoverability of another professor\u2019s tenure file.\u00a0 Judge Heckman issued a protective order permitting plaintiff to review the file but prohibiting him from communicating the contents of the file in any way.\u00a0 The day after reviewing the file, the plaintiff circulated a memorandum to the law faculty at the University of Buffalo Law School, prompting Judge Heckman to issue an Order to Show Cause why the District Court should not hold the plaintiff in contempt.\u00a0 Judge Skretny, the district judge assigned to the case, determined that the plaintiff was in contempt of court, a finding which fueled a further barrage of discourteous and uncivil filings by the plaintiff, and led to a finding that plaintiff\u2019s conduct was sanctionable under Rule 37 of the Federal Rules of Civil Procedure and the Court\u2019s own inherent power and the dismissal of the case.\u00a0 The Second Circuit affirmed the District Court\u2019s dismissal.<\/span><span data-ccp-props=\"{&quot;134233279&quot;:true,&quot;201341983&quot;:0,&quot;335559739&quot;:0,&quot;335559740&quot;:240}\">\u00a0<\/span><\/p>\n<p style=\"padding-left: 40px;\"><i><span data-contrast=\"auto\">Blum v.
